Terms of Service - Tilefusion

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Tilefusion ("we," "us," or "our") regarding your use of the Tilefusion mobile application ("App").

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Important: If you do not agree to these Terms, you must not download, install, or use the App.

2. License to Use

2.1 Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device(s) for personal, non-commercial entertainment purposes.

2.2 Restrictions

You agree NOT to:

✕ Copy, modify, adapt, translate, or create derivative works of the App
✕ Reverse engineer, decompile, disassemble, or attempt to derive the source code
✕ Distribute, sell, rent, lease, sublicense, or transfer the App to any third party
✕ Remove, alter, or obscure any copyright, trademark, or other proprietary notices
✕ Use the App for any illegal, unauthorized, or commercial purpose
✕ Attempt to gain unauthorized access to any part of the App or its related systems
✕ Use automated tools (bots, scripts) to interact with the App or Game Center
✕ Exploit bugs or glitches for unfair competitive advantage

3. Ownership and Intellectual Property

The App, including all content, features, functionality, graphics, code, and user interface design, is owned by us and protected by international intellectual property laws.

™️ Trademarks

"Tilefusion" and all related names, logos, product names, designs, and slogans are trademarks of Tilefusion. You may not use these marks without our prior written permission.

💾 Your Data

You retain all rights to your gameplay data stored locally. By using Game Center, you grant Apple limited rights to your scores and achievements as described in Apple's terms.

4. User Conduct

You agree to use the App in a manner consistent with all applicable laws and regulations. You will NOT:

✕ Harass, abuse, or harm other users through Game Center or any other means
✕ Impersonate any person or entity
✕ Interfere with or disrupt the App's functionality or servers
✕ Use offensive, inappropriate, or misleading usernames or profile information
✕ Attempt to cheat, manipulate leaderboards, or gain unfair advantages
✕ Share exploits, hacks, or cheating methods with others

5. Game Center Integration

The App integrates with Apple's Game Center service. Your use of Game Center features is also governed by:

• Apple's Terms of Service
• Apple's Privacy Policy
• Apple's Game Center Terms and Conditions

We reserve the right to remove scores or revoke achievements if we detect cheating, exploitation, or violation of these Terms.

6. App Availability and Updates

6.1 Availability

We strive to keep the App available and functional at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to:

• Maintenance and updates
• Technical issues or server problems
• Events beyond our reasonable control

6.2 Updates and Modifications

We may release updates, patches, or new versions of the App at any time. These updates may:

+ Add new features or functionality
+ Fix bugs or improve performance
~ Modify or remove existing features
~ Change gameplay mechanics or scoring

Updates may be required to continue using the App. By continuing to use the App after an update, you agree to the updated version.

7. Termination

Your Right

You may stop using the App at any time by deleting it from your device. You may also request data deletion as described in our Privacy Policy.

Our Right

We reserve the right to suspend or terminate your access if you violate these Terms, engage in cheating, or if we discontinue the App.

Effect

Upon termination, your license to use the App immediately ends. You must delete the App from your device.

8. Disclaimers and Warranties

IMPORTANT NOTICE

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

8.1 No Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties that defects will be corrected

8.2 Your Responsibility

You acknowledge that you use the App at your own risk, are responsible for any damage to your device or loss of data, and that we do not guarantee preservation of your game data or scores.

9. Limitation of Liability

IMPORTANT LIABILITY LIMITATION

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TILEFUSION, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to loss of profits, data, use, goodwill, or other intangible losses arising from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers or your personal information
• Any bugs, viruses, or malicious code transmitted through the App
• Any errors or omissions in content or functionality
• Any loss of game data, scores, or achievements
• Any conduct or content of third parties

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid to download the App (which is currently $0, as the App is free).

10. Indemnification

You agree to defend, indemnify, and hold harmless Tilefusion and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any law or the rights of a third party
• Any content or data you submit through Game Center or other features

11. Apple App Store Requirements

These Terms are between you and Tilefusion only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App.

Apple will have no warranty obligation with respect to the App, and any other claims relating to the App are our responsibility, not Apple's.

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you as a third-party beneficiary.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tilefusion is registered, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal claim, you agree to contact us at sarunas.kazlauskas@gmail.com to attempt to resolve the dispute informally.

12.3 Arbitration

If we cannot resolve a dispute informally, any dispute arising from these Terms or the App shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

13. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

14. Children's Use

The App is designed to be appropriate for all ages, including children. We comply with COPPA and do not knowingly collect personal information from children. Parents and guardians should supervise children's use of the App.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the "Last Updated" date at the top when changes are made. Your continued use of the App after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tilefusion regarding the App and supersede all prior agreements and understandings.

19. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
